1. Agreement to Terms

Welcome to ArtisanPromoter. These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "User") and ArtisanPromoter ("we," "us," "our," or "Company") governing your use of our managed social media service.

By creating an account or using our service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our service.

These Terms incorporate our Privacy Policy and How We Work With Platforms page by reference.

2. Service Description

ArtisanPromoter provides a managed social media service designed for Etsy sellers. When you subscribe to our service:

  • We connect to your Etsy shop to access your product listings, images, and descriptions (read-only access via OAuth 2.0)
  • We learn about your brand, target audience, and content preferences
  • Our team uses AI assistance to generate social media content based on your products
  • Our editorial team manually reviews and approves every piece of content
  • We publish the approved content to your connected social media accounts on your behalf

2.1 What We Do

  • Create social media content for Facebook, Instagram, Pinterest, X, and LinkedIn
  • Schedule and publish posts to your connected accounts
  • Monitor content performance and provide insights
  • Maintain compliance with each platform's API policies and terms of service

2.2 What We Do NOT Do

  • Modify your Etsy shop or listings
  • Post spam, misleading content, or content that violates platform policies
  • Train AI models on your Etsy data or social media data
  • Sell your data to third parties
  • Engage in fake engagement, mass following, or other prohibited automation practices

3. Automated Posting Consent

⚠️ Important: Your Consent to Automated Posting

By using ArtisanPromoter, you expressly consent to our posting content on your behalf to your connected social media accounts. You understand that:

1. Our editorial team creates and reviews content before it is published
2. Content is automatically delivered to your social media accounts at scheduled times
3. You may see content after it has already been published
4. You can revoke this consent at any time by disconnecting your accounts or contacting us

3.1 What You Consent To

When you connect your social media accounts to ArtisanPromoter, you consent to:

  • Automated Posting: We will publish content to your Facebook Page, Instagram Business account, Pinterest boards, X account, and/or LinkedIn profile or page on your behalf.
  • Content Creation: We will use your Etsy listings to create derivative social media content (posts, captions, descriptions).
  • Scheduled Delivery: Content may be scheduled and delivered automatically without requiring your approval for each individual post.

Meta/Facebook/Instagram Content Policy: In compliance with Meta's Developer Policies (Section 2.1), we do not prefill captions, comments, messages, or posts. All content published to your Facebook or Instagram account is uniquely created by our editorial team (employees of ArtisanPromoter acting on your behalf) and is individually reviewed before publishing. Content is not auto-generated or pre-filled in a way that would violate Meta's policies.

3.2 How to Revoke Consent

You may revoke your consent at any time by:

  • Disconnecting your social media accounts through our app or the platform's settings
  • Contacting us at support@artisanpromoter.com
  • Deleting your ArtisanPromoter account

Upon revocation, we will stop posting to your accounts immediately. Content already published will remain on those platforms until you delete it there.

3.3 X Automation Rules

In compliance with X's Automation Rules, Developer Agreement, and Developer Policy, by connecting your X account, you:

  • Provide Express Consent: You explicitly consent to automated posting on your behalf. Authentication alone does not constitute consent—you are providing informed consent through this agreement.
  • Understand What Will Be Posted: We show you the content that will be published before scheduling. Content is created by our editorial team based on your Etsy listings.
  • Can Revoke Access: You may revoke access at any time through your X account settings or by contacting us. Revocation takes effect immediately.
  • Acknowledge Responsibility: You are responsible for content posted from your account and ensuring it complies with X's Rules.

Prohibited Activities Under X's Policies: We do NOT engage in the following prohibited activities on X:

• Automated likes (banned entirely by X)
• Identical or substantially similar content across multiple accounts
• Bulk following, unfollowing, or aggressive following behavior
• Unsolicited @mentions, replies, or direct messages
• Trend manipulation or posting to trending topics for visibility
• Engagement selling (selling likes, follows, retweets)
• Using X Content to train AI/ML models
• Surveillance, tracking, or profiling of X users
• Deriving sensitive information about X users
• Scraping or browser automation (official API only)

X Content Deletion

In compliance with X's Developer Policy, we will delete X Content from our systems within 24 hours when:

  • X requests deletion
  • You request deletion of your content
  • Content is deleted, suspended, or withheld on X

Off-X Matching Consent

We do not associate your X username or user ID with off-platform identifiers (such as customer records, email addresses, or device IDs) without your express opt-in consent. By using our service, you understand that we may display your X profile information (handle, avatar, display name) within our application for account management purposes only.

4. Subscription & Payments

4.1 Subscription Plans

ArtisanPromoter offers subscription plans with different features and posting frequencies. Current pricing and plan details are available on our website.

4.2 Billing

  • Billing Cycle: Subscriptions are billed monthly or annually, depending on your selected plan.
  • Payment Method: You must provide a valid payment method to use the service.
  • Auto-Renewal: Subscriptions automatically renew unless cancelled before the renewal date.
  • Price Changes: We may change prices with 30 days' notice. Your continued use constitutes acceptance of new prices.

4.3 Refunds

We offer refunds on a case-by-case basis. If you are unsatisfied with our service, please contact us at support@artisanpromoter.com within 14 days of your charge to request a refund. Refunds are not guaranteed and are at our discretion.

4.4 Taxes

You are responsible for any applicable taxes related to your use of the service. Prices may not include all applicable taxes in your jurisdiction.

5. Your Responsibilities

As a user of ArtisanPromoter, you agree to:

5.1 Account Information

  • Provide accurate and complete information when creating your account
  • Keep your account credentials secure
  • Notify us immediately of any unauthorized access to your account

5.2 Platform Access

  • Ensure you have the right to authorize us to post on your social media accounts
  • Maintain active accounts on connected platforms
  • Not revoke OAuth access without notifying us if you wish to continue service
  • Ensure your connected accounts comply with each platform's terms of service

5.3 Content Rights

  • Confirm you own or have rights to use the product images and content from your Etsy shop
  • Ensure your products and brand do not violate any laws or third-party rights
  • Notify us if any content we create infringes on your or others' rights

5.4 Compliance

  • Comply with all applicable laws and regulations
  • Comply with the terms of service of Etsy, Facebook, Instagram, Pinterest, X, and LinkedIn
  • Not use our service for any illegal or unauthorized purpose

6. Our Responsibilities

ArtisanPromoter commits to:

6.1 Service Quality

  • Create high-quality, professional social media content for your brand
  • Manually review all content before publishing
  • Maintain consistent posting schedules as outlined in your subscription plan
  • Ensure content is appropriate for each platform's audience and guidelines

6.2 API Compliance

  • Use official APIs for all platform integrations
  • Respect rate limits and usage guidelines for each platform
  • Comply with Etsy, Meta, Pinterest, X, and LinkedIn developer policies
  • Not engage in prohibited automation practices (spam, fake engagement, etc.)

6.3 Data Protection

  • Protect your personal information as described in our Privacy Policy
  • Not sell your data to third parties
  • Delete your data upon request as outlined in our Privacy Policy

6.4 Support

  • Provide customer support via email at support@artisanpromoter.com
  • Respond to all inquiries within 48 hours during business days
  • Maintain a monitored support channel for urgent issues

7. Content Ownership

7.1 Your Content

You retain all ownership rights to your original content, including:

  • Product images from your Etsy shop
  • Product descriptions and listing content
  • Your brand name, logo, and other brand assets
  • Any content you provide to us directly

By using our service, you grant us a limited license to use your content solely to provide the service (e.g., creating social media posts, publishing to your accounts).

7.2 Generated Content

Social media content created by ArtisanPromoter (including AI-generated captions, descriptions, and post variations) is owned by ArtisanPromoter but licensed to you for use in connection with your business and the published posts.

7.3 Content License Grant

You grant ArtisanPromoter a worldwide, non-exclusive license to:

  • Access your Etsy listings via the Etsy API
  • Use your product images and descriptions to create social media content
  • Publish created content to your connected social media accounts
  • Display content in our app for your review and records

8. Platform Compliance

ArtisanPromoter is designed to comply with the terms of service and API policies of all platforms we integrate with. You agree to:

8.1 Etsy

  • Comply with Etsy's Terms of Use and API Terms
  • Only connect Etsy shops that you own or are authorized to represent
  • Not use our service to violate Etsy's policies

Required Etsy Disclaimer

THIS APPLICATION IS SOLELY PROVIDED BY ArtisanPromoter (THE "APPLICATION DEVELOPER"). YOU ACKNOWLEDGE THAT ETSY, INC. AND ITS AFFILIATES ARE NOT THE APPLICATION DEVELOPER, DO NOT PROVIDE THE APPLICATION SERVICE, AND MAKE NO WARRANTIES OF ANY KIND WITH RESPECT TO THE APPLICATION OR DATA ACCESSED THROUGH IT.

8.2 Meta (Facebook & Instagram)

  • Comply with Meta's Terms of Service and Platform Terms
  • Comply with Meta's Developer Policies
  • Only connect accounts you are authorized to manage
  • Ensure content complies with Meta's Community Standards

Meta/Facebook/Instagram Disclaimer

THIS APPLICATION USES META'S APIS BUT IS NOT ENDORSED, CERTIFIED, OR OTHERWISE APPROVED BY META PLATFORMS, INC. YOU ACKNOWLEDGE AND AGREE THAT:

(a) Meta is not the application developer and does not provide this service;
(b) Meta makes no warranties of any kind with respect to this application or data accessed through it;
(c) We do not collect, store, or solicit your Facebook or Instagram login credentials;
(d) We will notify Meta within 24 hours of any security incident involving Platform Data;
(e) We comply with Meta's Platform Terms and Developer Policies in our use of Platform Data.

Platform Data Handling

In connection with Meta's Platform Terms, we agree that we will NOT:

  • Sell, license, or purchase Platform Data received from Meta's APIs
  • Use Platform Data for surveillance or provide tools that enable surveillance
  • Attempt to decode, circumvent, re-identify, or de-anonymize Platform Data
  • Process Platform Data to discriminate based on protected characteristics
  • Use Platform Data for eligibility determinations (housing, employment, insurance, credit, etc.)
  • Transfer or share user IDs or access tokens except with authorized Service Providers

Security Incident Notification

If we become aware of any unauthorized processing of Platform Data or any incident likely to compromise the security or confidentiality of Meta's IT systems, we will notify Meta within 24 hours and immediately begin remediation efforts, in accordance with Meta's Platform Terms (Section 6).

EEA/UK Data Transfers

For users located in the European Economic Area (EEA) or United Kingdom, transfers of personal data from Meta to us are governed by Meta's Standard Contractual Clauses (Module One: Controller to Controller). Ireland is designated as the Member State for dispute resolution under these clauses. We implement Meta's Technical and Organisational Measures as required for such transfers.

8.3 Pinterest

  • Comply with Pinterest's Terms of Service and Developer Guidelines
  • Only connect accounts you own or are authorized to manage
  • Ensure content complies with Pinterest's Community Guidelines
  • No Cross-Account Data Combination: We do not combine your Pinterest account information with information from other Pinterest accounts or with information from other services
  • No Off-Pinterest Ad Targeting: We do not use Pinterest data to target you or others with advertising outside of Pinterest

Your Authorization: By connecting your Pinterest account, you appoint ArtisanPromoter as your authorized agent to create, select, and publish Pins on your behalf. Our editorial team manually reviews and approves each individual Pin before publishing—no Pins are published automatically without human review and approval. Each Pin is chosen individually by our team acting on your behalf.

8.4 X

  • Comply with X's Terms of Service, Developer Agreement, Developer Policy, and Restricted Use Rules
  • Only connect accounts you own
  • Ensure content complies with X's Rules
  • Not request that we perform automated likes (this is banned by X's policies)
  • Not post identical content across multiple X accounts
  • Not use our service for surveillance, tracking, or profiling X users

X Disclaimer

THIS APPLICATION USES X'S APIS BUT IS NOT ENDORSED, CERTIFIED, OR OTHERWISE APPROVED BY X CORP. YOU ACKNOWLEDGE AND AGREE THAT:

(a) X is not the application developer and does not provide this service;
(b) X makes no warranties of any kind with respect to this application or data accessed through it;
(c) We do not collect, store, or solicit your X login credentials;
(d) We do not use X Content to train AI models;
(e) We comply with X's Developer Agreement, Developer Policy, and Automation Rules;
(f) We will notify X immediately of any security breach involving X data.

X Security Requirements

In accordance with X's Developer Agreement (Section III.G), we maintain industry-standard security measures to protect X Content, do not share API credentials with third parties, and will immediately notify X of any security breach or potential vulnerability related to the Licensed Material.

X Data Protection

We comply with X's Controller-to-Controller Data Protection Addendum. For users in the European Union, EFTA States, or United Kingdom, data transfers are governed by Irish law and disputes are resolved in Irish courts, as specified in X's Developer Agreement.

8.5 LinkedIn

We use the LinkedIn Marketing API (a vetted API program) to publish content to your LinkedIn Page or profile. LinkedIn's general API does not permit automated posting—you must use the Marketing API for this purpose.

  • Comply with LinkedIn's User Agreement, API Terms of Use, and Marketing API Terms
  • Only connect accounts or pages you are authorized to manage (as an Account Manager or Authorized Client)
  • Ensure content complies with LinkedIn's Professional Community Policies
  • Content must be professional in tone and appropriate for LinkedIn's business-focused audience
  • No spam, misleading content, or content that violates LinkedIn's community standards

LinkedIn Data Handling

For data received from LinkedIn's Marketing APIs ("Marketing Data"), we comply with the following:

  • Authorized Access Only: We only access LinkedIn accounts on behalf of Authorized Clients (Account Managers or those they authorize).
  • No Password Storage: We never collect, store, or request your LinkedIn login credentials. We access your accounts only through OAuth tokens.
  • Data Deletion: We delete stored LinkedIn Marketing Data within 10 days when you cease using our service or request deletion.
  • No Scraping: We do not use bots, crawlers, or automated methods to scrape LinkedIn data outside the official Marketing API.
  • No Data Resale: We do not sell, rent, or share LinkedIn data with third parties except as required to provide our service.
  • Analytics Data Only: We only use LinkedIn Analytics Data (Page Analytics, Member Analytics) to provide reporting to you about your account performance.

Security Incident Notification

If we become aware of any security incident involving LinkedIn Marketing Data, we will notify LinkedIn within 24 hours at security@linkedin.com and immediately begin remediation, in accordance with LinkedIn's API Terms of Use (Section 7.1.d).

LinkedIn Disclaimer

THIS APPLICATION USES LINKEDIN'S MARKETING APIS BUT IS NOT ENDORSED, CERTIFIED, OR OTHERWISE APPROVED BY LINKEDIN. YOU ACKNOWLEDGE AND AGREE THAT:

(a) LinkedIn is not the application developer and does not provide this service;
(b) LinkedIn makes no warranties of any kind with respect to this application or data accessed through it;
(c) We do not collect, store, or solicit your LinkedIn login credentials;
(d) We comply with LinkedIn's API Terms of Use and Marketing API Terms;
(e) We will notify LinkedIn within 24 hours of any security incident involving Marketing Data.

8.6 Platform Changes

If a platform changes its API access, policies, or terms in a way that prevents us from providing service to that platform, we will notify you and may suspend posting to that platform. We are not liable for service interruptions caused by platform policy changes.

9. Termination

9.1 Termination by You

You may terminate your subscription and delete your account at any time by:

  • Using the account deletion feature in your account settings
  • Contacting us at support@artisanpromoter.com

Upon termination:

  • Your subscription will not renew
  • We will delete your account information and OAuth tokens within 30 days
  • Content already published to social media platforms will remain there until you delete it
  • No refunds are provided for partial subscription periods (unless required by law)

9.2 Termination by Us

We may suspend or terminate your account if:

  • You violate these Terms or our policies
  • Your use of the service is illegal or harms others
  • We are required to do so by law or platform policies
  • We discontinue the service (with at least 30 days' prior notice via email)

In the event we discontinue the service entirely, we will provide at least 30 days' written notice to you and to relevant platform partners (including Etsy), and will assist in transitioning your data and maintaining service continuity during the notice period.

9.3 Survival

The following sections survive termination: 7 (Content Ownership), 10 (Disclaimers), 11 (Limitation of Liability), 12 (Indemnification), and 13 (Governing Law).

10. Disclaimers

10.1 Service Provided "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10.2 No Guarantee of Results

We do not guarantee specific results from using our service, including but not limited to:

  • Increased sales, traffic, or engagement
  • Followers, likes, comments, or other metrics
  • Specific ranking or visibility on any platform

10.3 Platform Dependencies

Our service depends on third-party platforms (Etsy, Meta, Pinterest, X, LinkedIn). We are not responsible for:

  • Platform outages, API changes, or policy changes
  • Platform decisions to suspend or terminate your accounts
  • Changes to platform features, rate limits, or access
  • Content moderation decisions made by platforms

10.4 Third-Party Links

Content published by our service may link to third-party websites (e.g., your Etsy shop). We are not responsible for third-party content or practices.

11. Limitation of Liability

11.1 Limitation

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ArtisanPromoter AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

  • ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
  • ANY DAMAGES RESULTING FROM PLATFORM POLICY CHANGES OR API RESTRICTIONS
  • ANY DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO YOUR ACCOUNT

11.2 Cap

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11.3 Exceptions

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless ArtisanPromoter and its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or relating to:

  • Your use of the service
  • Your violation of these Terms
  • Your violation of any third-party rights (including intellectual property rights)
  • Your violation of any platform's terms of service or policies
  • Content you provide or that is derived from your Etsy shop
  • Your products, services, or business practices

13. Governing Law & Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

13.2 Jurisdiction

Any disputes arising under these Terms shall be resolved in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.

13.3 Class Action Waiver

You agree not to participate in class actions, class arbitrations, or representative actions against us. You agree to resolve any disputes individually.

14. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will:

  • Update the "Last Updated" date at the top of this document
  • Notify you by email for significant changes (where we have your email)
  • Post the updated Terms on our website

Your continued use of the service after changes become effective constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the service.
